The Construction Manager shall maintain a procedure for the inspection, processing, and payment of applications by Trade Contractors, vendors and materialmen for progress and final payments, including obtaining waivers of lien so as to assure a lien-free Project. The Construction Manager shall review and certify the amounts due each respective Trade Contractor. The Construction Manager’s certification for payment shall constitute a representation to Owner that (i) the Work claimed to have been performed by such Trade Contractor has been performed in a good and workmanlike manner and has progressed to the point indicated and (ii) the Construction Manager has reviewed copies of requisitions received from such Trade Contractor and material suppliers to substantiate such Trade Contractor’s right to payment. Once the Construction Manager is paid by Owner, the Construction Manager must immediately make payments to the Trade Contractors
